Terms of Service

By accessing or using GrabSketch ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users and others who access or use the Service.

We reserve the right to update these Terms at any time. We will notify you of significant changes by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

GrabSketch is a web-based furniture and kitchen design tool that allows users to create, configure and visualise furniture projects including kitchens, wardrobes and other cabinet furniture. The Service includes a 3D configurator, project management features, and a library of components and materials.

We reserve the right to modify, suspend or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension or discontinuation of the Service.

To access certain features of the Service you must create an account. You agree to provide accurate, current and complete information during registration and to keep your account information up to date.

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.
• You may not share your account with, or transfer it to, any other person.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable prior notice where possible.

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe the intellectual property rights of any third party.
• Upload or transmit malicious code, viruses or any other harmful software.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Scrape, crawl or systematically extract data from the Service without our written consent.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Engage in any activity that disrupts or interferes with the Service or servers connected to it.

Violation of these provisions may result in immediate termination of your account without refund.

The Service and its original content, features, and functionality — including but not limited to software, design, text, graphics and logos — are and will remain the exclusive property of GrabSketch and its licensors, protected by copyright, trademark and other intellectual property laws.

You retain ownership of the project data and designs you create using the Service. By using the Service, you grant us a limited, non-exclusive licence to store, display and process your project data solely for the purpose of providing the Service to you.

You may not reproduce, distribute, modify or create derivative works of any part of the Service without our prior written consent.

Third-party product names and trademarks. Manufacturer names, product models, article numbers and trademarks displayed within the Service are the property of their respective owners and are used solely to identify compatible products. Use of such names does not imply any partnership, sponsorship or endorsement by the trademark owner.

Certain features of the Service may require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. All fees are exclusive of taxes unless stated otherwise.

• Subscriptions are billed in advance on a monthly or annual basis.
• You authorise us to charge your payment method on a recurring basis.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• We do not provide refunds for unused portions of a subscription period, except where required by law.

We reserve the right to change subscription pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

You are solely responsible for any content, designs or data you submit, upload or create through the Service ("User Content"). You represent and warrant that your User Content does not infringe any third-party rights and complies with all applicable laws.

We do not claim ownership of your User Content. However, by submitting User Content, you grant us a worldwide, royalty-free licence to use, reproduce and display it solely to the extent necessary to provide the Service.

We reserve the right to remove any User Content that violates these Terms or that we deem, in our sole discretion, to be inappropriate or harmful.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free or free of harmful components, or that any defects will be corrected.

Accuracy of outputs. GrabSketch is a planning and visualisation tool. All dimensions, measurements, configurations, material quantities, pricing estimates and any other outputs generated by the Service are approximate and for illustrative purposes only. We do not represent or warrant that any output is accurate, complete, current or suitable for any specific purpose. Data may be subject to change without notice.

Professional verification required. Before placing any orders, commencing construction, or making any purchasing or financial decisions based on outputs from the Service, you must independently verify all designs, measurements, specifications and cost estimates with a qualified professional (such as a certified designer, architect or contractor). Reliance on unverified outputs is solely at your own risk.

GrabSketch expressly disclaims all liability for any costs, financial losses, damages, defects or claims arising from reliance on outputs that have not been independently verified.

To the fullest extent permitted by law, GrabSketch shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of profits or loss of goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100 if no payment was made.

The Service may contain links to third-party websites or integrate with third-party services. These links are provided for convenience only. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time from the account settings page. Sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the Republic of Estonia, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Tallinn, Estonia.
